In brief

  • The SEC's Division of Examinations published its FY2027 priorities, explicitly naming "super intelligence and other advanced technologies" as an area of heightened scrutiny for the first time.
  • Tokenization also made the list under evolving market infrastructure risks, alongside Treasury clearing reforms—a signal that broker-dealers, advisers, and transfer agents should expect examiner attention on tokenized products.
  • The priorities cover the Division's more than 34,000 registrants.

The SEC's Division of Examinations dropped its FY2027 priorities on Thursday, and buried in the eight-point list it included "super intelligence and other advanced technologies that may affect market operations, compliance, fraud prevention, and investor protection” as part of its official examination playbook.

The broader technology bullet groups AI under a category called "emerging technologies," which also signals the Division's intent to scrutinize how AI tools affect compliance programs and fraud detection across registrants.

That's a shift in scope—prior editions focused on AI as a business tool advisers were adopting; the 2027 language positions it as a systemic market variable.

Tokenization got its own bullet under market infrastructure. The Division listed "risks associated with evolving market infrastructure, including Treasury clearing reforms, tokenization, and related developments" as a priority area.

For brokers, investment advisers, and transfer agents already building out tokenized product lines under the Atkins-era regulatory thaw, that line means their compliance programs will now draw examiner attention—not just policy attention.

Director Keith Cassidy framed the priorities as an adaptive posture. "Our approach enables us to adapt to changing market conditions, identify developing risk patterns, respond to emerging threats, and anticipate areas where investors and the markets may be vulnerable," he said in the SEC’s release.

The Division explicitly noted the list isn't exhaustive—examiners retain discretion to review anything touching federal securities law compliance across the full registrant base.

The FY2026 exam priorities, released in November 2025, were notable for dropping crypto as a standalone focus area for the first time since 2021—a signal, at the time, that the Paul Atkins SEC was pulling back from the Gary Gensler-era enforcement posture.

The 2027 document doesn't restore that section, but it does fold AI risk and tokenization into the list, covering the two technology trends that have most shaped capital markets activity in the past year.

The Division's examination program now covers more than 34,000 registrants, including investment advisers, investment companies, broker-dealers, clearing agencies, and transfer agents.
